Information on Data Processing Operations

We indicate the respective legal basis for individual processing operations. If we intend to transfer data to third countries outside the European Union (EU) or the European Economic Area (EEA), this will also be indicated.

Data Subject Rights

As a data subject, you have the following rights:

  • Pursuant to Article 15 of the GDPR, you may request access to your personal data that we process; furthermore, you may request information regarding the purposes of processing, the categories of personal data being processed, the recipients or categories of recipients to whom your data has been or will be disclosed, the planned retention period or the criteria for determining the retention period, the origin of your data if it was not collected directly from you, the existence of automated decision-making, including profiling, and, where applicable, meaningful information regarding its details, such as the logic, scope, and effects; the existence of a right to rectification or erasure of the data concerning you; the right to restrict processing or to object to such processing; and the existence of a right to lodge a complaint with the supervisory authority; finally, you have the right to be informed whether personal data has been transferred to a third country or to an international organization and—if so—about the appropriate safeguards in connection with the transfer;
  • pursuant to Article 16 of the GDPR, you may request the immediate rectification of inaccurate personal data or the completion of your personal data stored by us;
  • Pursuant to Article 17 of the GDPR, you may request the erasure of your personal data stored by us, unless the processing is necessary for the exercise of the right to freedom of expression and information, to comply with a legal obligation, for reasons of public interest, or to establish, exercise, or defend legal claims;
  • Pursuant to Article 18 of the GDPR, you may request the restriction of the processing of your personal data if you contest the accuracy of the data, the processing is unlawful but you oppose its erasure, and we no longer need the data; if you require the data that we no longer need to assert, exercise, or defend legal claims, or you have objected to the processing pursuant to Article 21 of the GDPR, but it has not yet been determined whether our legitimate grounds for data processing override your interests;
  • pursuant to Article 20 of the GDPR, you may request that we provide you with the personal data you have provided to us in a structured, commonly used, and machine-readable format, or that we transfer it to another controller;
  • Pursuant to Article 21 of the GDPR, you may object to the processing of your personal data if there are grounds for doing so arising from your particular situation, or if the objection relates to direct marketing and the legal basis for the processing of the personal data is legitimate interests pursuant to Article 6(1), first sentence, letter f of the GDPR;
  • Pursuant to Article 7(3) of the GDPR, you may withdraw your consent at any time by notifying us. As a result, we may no longer continue processing the data based on that consent in the future;
  • Pursuant to Article 77 of the GDPR, you may lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, your place of work, or the location of the alleged infringement.

If you wish to exercise the above-mentioned data subject rights, you may contact us at any time using the contact information provided above.

Erasure and Restriction of Personal Data

Unless otherwise specified in this Privacy Policy for specific cases, personal data will be erased when it is no longer necessary for the purposes for which it was collected or otherwise processed and when there are no longer any legal retention obligations. We will erase the personal data we process upon request, subject to the conditions set forth in Article 17 of the GDPR. Personal data required for other legally permissible purposes will not be erased. This applies, for example, to personal data necessary for the pursuit of any claims to which we are entitled and which we are required to retain for commercial or tax law reasons. For example, documents pursuant to Section 257(1)(2) and (3) of the German Commercial Code (HGB) as well as Section 147(1)(2), (3), 5 of the German Fiscal Code (AO) are retained for 6 years; documents pursuant to Section 257(1)(1) and (4) of the German Commercial Code (HGB) and Section 147(1)(1), (4), and (4a) of the German Fiscal Code (AO) are retained for 10 years.

The processing of this data is restricted in accordance with Article 18 of the GDPR, and the data is not processed for any other purposes.

Consent to the Transfer of Personal Data to the U.S. and Other Third Countries

If we ask for your consent pursuant to Article 49(1)(a) of the GDPR as the legal basis for the transfer of data to the United States and/or other third countries, the following conditions apply to this consent:

  • Your personal data may be transferred to a country or an international organization outside the European Union (EU) or the European Economic Area (EEA). Subject to statutory or contractual authorizations, personal data is transferred in accordance with the requirements set forth in Articles 44 et seq. of the GDPR. This means that, for the country in question, there is an adequacy decision by the European Commission pursuant to Article 45 of the GDPR, appropriate safeguards for data protection pursuant to Article 46 of the GDPR, or binding corporate rules pursuant to Article 47 of the GDPR to ensure an adequate level of data protection. Further information can be found in the explanations regarding the respective processing operations in this Privacy Policy.
  • The European Commission’s adequacy decision for the United States requires, as a condition for an adequate level of data protection, that recipients of personal data transferred to the United States be certified under the EU-U.S. Data Privacy Framework. Nevertheless, there is a risk in the United States that government authorities may access your data without your knowledge and without you being able to take legal action against such access.
  • For some countries, there is no adequacy decision by the European Commission under Article 45 of the GDPR, and it may not be possible to establish an adequate level of data protection equivalent to that in the European Union either through appropriate safeguards under Article 46 of the GDPR or through binding corporate rules under Article 47 of the GDPR. There is a risk that these third countries do not offer an adequate level of protection. It is possible that these third countries do not have a supervisory authority and/or data processing principles, and/or that you, as a data subject, may not have data protection rights in the third country. Consequently, in the event of violations of your rights in these countries, you may not have sufficient legal remedies available to defend yourself against such violations.
